This study examines the legal dispute between the State of Libya and Al-Jallouli Company, highlighting the procedural discrepancy between French and Swiss courts regarding a null and void arbitral award. The research finds that the Paris Court of Appeal successfully stripped the award of its legitimacy by proving the usurpation of authority and the non- existence of the arbitration agreement, leading to the release of National Oil Corporation (NOC) assets. Conversely, the Swiss Federal Tribunal adopted a strict formalistic approach, upholding the same null award on the grounds of missing mandatory statutory deadlines ($LDIP$). This resulted in the confirmation of the seizure of the sovereign Collonge Property in Geneva. The study concludes that there is a critical need to balance substantive truth with procedural certainty, recommending that the Libyan state enforce administrative liability for missed deadlines and develop proactive defense strategies to protect its foreign assets from procedural immunization risks.
